End User Agreement

This End User Agreement (“Agreement”) is a legal agreement between you (“User”) and
Setscale, Inc. (“Setscale”) regarding your use of Setscale’s services and website located at
www.setscale.com (“Website”). By accessing or using the Website, you agree to be bound by the
terms and conditions of this Agreement.

Acceptance of Terms. By using the Website, you acknowledge that you have read,
understood, and agree to be bound by this Agreement, and that you comply with all
applicable laws and regulations. If you do not agree to these terms, you must not use the

with the use of the Website or this Agreement, even if Setscale has been advised of the
possibility of such damages.
Indemnification. You agree to indemnify and hold Setscale, its officers, directors, employees, and agents harmless from any claims, liabilities, damages, losses, costs, or expenses, including attorney’s fees, arising out of or in connection with your use of the Website or any violation of this Agreement.
Termination. Setscale may terminate or suspend your access to the Website at any time, with or without cause, without prior notice or liability.
Governing Law and Jurisdiction. This Agreement shall be governed by and construed in accordance with the laws of the state of Delaware, without regard to its conflict of laws principles. Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware.
Severability. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Entire Agreement This Agreement constitutes the entire agreement between you and Setscale regarding your use of the Website, superseding any prior agreements or understandings.

By using the Setscale website, you agree to abide by the terms and conditions outlined in this
End User Agreement. If you do not agree with any part of this Agreement, you should refrain
from using the Setscale website.
